As used in this Privacy Policy, “Moving Eye”, “We”, “Us” or “Our” refers to Moving Eye, informacijske tehnologije, d.o.o., a limited liability company with its registered address at Dalmatinova ulica 5, 1000 Ljubljana, Slovenia. Moving Eye is the controller of your personal data processed in connection with the Apps and Websites described below.

This Privacy Policy explains how we collect, use, disclose, transfer and store information about users in the European Economic Area, Switzerland and the United Kingdom (collectively, “Europe”), and information about their devices, received through their use of the Apps and Websites. If you are located outside Europe, our general Privacy Policy at https://movingeye.games/privacy applies instead.

This Privacy Policy is part of and incorporated by reference into the Terms of Service (the “Terms”) governing the use of all Moving Eye branded software applications (the “Applications” or “Apps”), which may operate on any type of computing device (including, without limitation, a mobile device). It also applies to your use of https://movingeye.games and any URL which may replace it or be added to the list of websites published by us and linking to this Privacy Policy (the “Websites”).

We take the privacy of our users and data security very seriously and believe in the right of our users to know which data is collected and for what purpose. We therefore strive to make our actions transparent, allow our users to control the collected data and remove it if they so wish, and take all reasonable precautions to prevent unauthorized access to this data.

We value your privacy and will never sell your information to anyone without your knowledge and consent.

We process your personal data only on the legal bases described in the “Legal Bases for Processing” section. Where the law requires your consent, for example for interest-based advertising, for accessing advertising identifiers on your device, or for Google Analytics Advertising Features, we ask for it through the consent choices presented in our Apps. You can change your choices at any time in the App settings.

We may receive information (including personal information) when you contact us or use the Apps or Websites. As described below, we may share it with our affiliates and with third-party Partners (as defined below) and use it in ways consistent with this Privacy Policy.

Please read this Privacy Policy to learn more about the data we collect, what we use it for and how we protect your privacy.

Collected Information

We use the information we collect primarily to provide you with a satisfactory service and enhance your Moving Eye experience, namely for:

  • delivering and improving our services and products, providing updates and technical troubleshooting, understanding and analyzing trends in the use of the Apps, and administering the Apps
  • analytics and research, including understanding usage trends, gathering demographic information about our user base, learning where the App was downloaded from, and creating reports for business intelligence
  • security, including enhancing the safety and security of our products and services
  • providing customer support and responding to your inquiries
  • complying with our legal obligations

We use SDKs from our business partners, which share collected information with us. For details, see the “Analytics” and “Advertising” sections below.

Device and Technical Information

We may collect data necessary for you to use our Apps, and for us to maintain and analyze the functioning of the Apps and personalize their content. We automatically obtain certain information about your device, including:

  • IP address and country or region
  • IDFA, IDFV and Advertising ID
  • Language and locale
  • Time zone and session start and stop time
  • Network status (Wi-Fi, etc.), browser plug-in types and versions
  • User agent string, platform, SDK version and timestamp
  • Our Apps installed on your device
  • Technical device information (e.g. device model and name, operating system name and version, CPU information, storage size, screen size, firmware, software, mobile carrier, internet service provider, API key identifier for the application, Android ID, Android serial number)
  • Player identifier string (collected only when you sign in to Google Play Games Services or Apple Game Center)

In addition, for users of Android devices we create a unique user ID, and for users of iOS devices we use the IDFV, to track your use of our Apps. Older versions of our Apps may still obtain information such as UDID or IMEI numbers. To prevent this, please update the App to the latest version available in your app store.

Information You Provide to Us

Our Apps have no account system, and we do not ask you for your name, email address, age, year of birth, gender or any other information that identifies you directly.

When you contact us directly, we may collect the information you provide, such as your name and surname, email address and the content of your message. We use it only for the purpose for which you provided it, and we do not share it with third parties except as described in the “Support” section. To have your contact information deleted, please email info@movingeye.games.

How We Use Your Information

We and our Partners use the information we collect about you and your device to deliver our services and operate our business, including:

1. Delivering Our Services

Developing, delivering and improving our products, services and content; tailoring our products and services; providing software updates and product support; administering the Apps and Websites; customizing your App experience; responding to your comments and questions and providing player support; presenting our offers in the App; allowing you to play our games; operating, maintaining and providing all App features and services now and in the future; verifying and confirming payments; and helping you solve technical difficulties.

2. Analytics and Research

Understanding and analyzing trends in the use of the Apps and Websites, auditing, learning about user behavior (how often you use the App or Website, events that occur within it, aggregated usage and performance data), gathering demographic information about our user base, and learning where the App was downloaded from. For information that may be treated as personal information, we use only device identifiers. We use data we receive from third-party social networks only for internal analytics.

Google Analytics for Firebase

We use Google Analytics for Firebase, provided by Google Ireland Limited, to understand how players use our Apps. This includes Google Analytics Advertising Features (Google signals and demographics and interests reporting).

Only if you have given consent, Google may use your device’s advertising identifier (Android Advertising ID or Apple IDFA) and information associated with your Google account (if you are signed in to Google and have turned on ads personalization) to provide us with aggregated reports about the age ranges, gender and interests of our players. These reports contain only aggregated data, and we cannot identify individual users from them.

You can withdraw your consent at any time in the App’s privacy settings, reset or delete your advertising ID in your device settings (see “Device Settings” below), or manage your Google ad settings at https://myadcenter.google.com. For more information on how Google uses data from apps that use its services, see https://policies.google.com/technologies/partner-sites.

3. Advertising

We offer our Apps for free or at low cost, and to do so we share information we collect with third-party advertising partners that help us deliver advertisements to you.

Contextual advertising. When you use our Apps, we show you contextual advertisements, which are based on the content of the App you are using rather than on your interests. To enable advertising, we allow our advertising partners to collect advertising identifiers, which are personal data under European data protection law. Our partners may use them only for contextual advertising (including frequency capping, fraud prevention, and attribution and billing), and for any other purpose only on an anonymized and aggregated basis that cannot be traced back to your device.

Interest-based advertising. Before sharing any information with our advertising partners for interest-based advertising, we always ask for your consent. If you consent, the ads you see are more relevant to you and are based on your app and device usage, online behavior and interests. See the “Who Can Show Personalized Ads to Me?” section.

You can withdraw or manage your consent at any time in the App settings. If you withdraw or do not give consent, you may still see the same number of ads, but they may be less relevant because they won’t be based on your interests, behavior or demographics. Our advertising partners may continue to show you ads based on the content of the App you are using.

Device Settings

You can also limit advertising tracking in your device settings:

  • iOS 14.5 and later: go to Settings → Privacy & Security → Tracking and turn off “Allow Apps to Request to Track”, or turn it off for a specific App. You can also turn off “Personalized Ads” under Settings → Privacy & Security → Apple Advertising.   • Android 12 and later: go to Settings → Google → Ads and tap “Delete advertising ID”. On older Android versions, go to Settings → Google → Ads and turn on “Opt out of Ads Personalization”.

4. Game Notifications

Our Apps may show local reminder notifications about your activities within the App. These are scheduled and sent by the App on your device only. They are not sent from our servers, and we do not collect notification tokens. You can turn them off at any time:

  • iOS: open Settings → Notifications, select the App, and turn notifications off.
  • Android: open Settings → Apps, select the App, choose Notifications, and turn them off. In some Apps, you can also disable notifications in the App’s Settings menu.

5. In-App Purchases

Our Apps enable in-app purchases. We do not process payments for in-app purchases and have no access to your credit card information. Payment transactions are completed by the app store through your app store account, and post-purchase processes are controlled by the app store and subject to its terms. Who Can Show Personalized Ads to Me?

Before sharing any information with our advertising partners for interest-based advertising, we always ask for your consent. With your consent, we share information that can identify your device, such as persistent identifiers (Advertising ID, IDFA, IP address), with our advertising partners, who may use it for interest-based advertising. For example, they may combine information gathered from our App with information gathered from other apps, websites or services, build profiles, and show you ads based on those profiles (for example, if your device has clicked on a sports ad in another publisher’s app, they may show you a sports ad in our App). We may also use and share such information with our advertising partners to target and optimize our own advertising and promotions in our Apps and in other publishers’ apps.

Our advertising partners show you interest-based ads only if you have consented to this sharing. They use different technologies that process your personal data in different ways, so please review their data processing practices before giving consent:

You can withdraw your consent at any time in the App settings, where you can manage your preferences. If you withdraw or do not give consent, you may still see the same number of ads, but they may be less relevant. Our advertising partners may continue to show you ads based on the content of the App you are using.

Tracking

When you use the App, we or third parties operating ad-serving technology may use information logged from your device through SDKs and similar technologies to ensure that appropriate advertising is shown in the App, to count unique and repeat ad views, and to measure the performance of our and our partners’ advertising campaigns (such as impressions, clicks, installs and post-install in-app events). We also use third-party tools to monitor ad visibility and the privacy compliance of third-party SDKs in our Apps, and to prevent fraud. Where this involves accessing information on your device that is not strictly necessary to provide the service, we do so only with your consent.

Legal Bases for Processing

We process your personal data on the following legal bases:

  • Performance of a contract: to provide the Apps, Websites and services you requested, including game progress, in-app purchases and player support.
  • Consent: for interest-based advertising; for accessing advertising identifiers and other information on your device where not strictly necessary; and for Google Analytics Advertising Features (demographics and interests reporting). You can withdraw consent at any time in the App settings or by contacting us, without affecting the lawfulness of processing before withdrawal.
  • Legitimate interests: for contextual advertising, basic analytics, security, fraud prevention and improving our Apps, where these interests are not overridden by your rights and interests.
  • Legal obligation: where we must process data to comply with the law.
  • Vital interests: in rare cases, to protect your vital interests or those of another person.

Sharing Your Personal Information

Partners Working for Us

We have partners who perform services on our behalf, such as data storage, technical or customer support, and data analytics. These processors are contractually required or bound by law to protect your data and may process it only in accordance with our agreements with them.

Other Companies and Public Authorities

We may supply or disclose your data, including personal information, to third parties based on your consent or where required by law.

We cannot provide all services necessary for the operation of our products ourselves, so we share collected information with third parties (collectively, “Partners”). Unless you have consented to interest-based advertising, the persistent identifiers we share with Partners (such as device ID, IDFA, IDFV, Advertising ID and IP address) are used only to:

  • place contextual advertising (including frequency capping, fraud prevention, and tracking for attribution and billing)
  • personalize App content
  • maintain or analyze the functioning of the Apps
  • perform network communications and protect the security or integrity of the user or the App
  • ensure legal or regulatory compliance

Third-Party Social Networks

Some of our Apps let you connect to third-party social networks, such as Google Play Games Services or Apple Game Center, to share content you created, participate in leaderboards or multiplayer games, log in on multiple devices and synchronize progress. If you use these features, you share information with other players and with the social network (for example, scores, rankings and achievements). You can disconnect your social network account or adjust its privacy settings at any time.

Support

If you submit a support request, we may receive your email address and other information you provide (“Support Information”). We use Support Information only to provide support to you. We do not rent, sell or share your email address without your express consent, except:

  • with our support providers, only to provide support to you
  • to enforce compliance with our license and user agreements, to respond to legal requirements, and at the request of governmental authorities
  • with a successor entity in connection with a merger, consolidation, sale of assets or other corporate reorganization, provided your email address continues to be used in compliance with this Privacy Policy

International Transfer

Your personal data is processed in Slovenia and may be transferred to other countries where Moving Eye or its service providers operate. We transfer your personal data outside Europe only where one of the following safeguards applies:

  1. The country ensures an adequate level of protection under a decision of the European Commission (or the relevant UK or Swiss authority), including the EU-U.S. Data Privacy Framework for certified US recipients.
  2. We have entered into Standard Contractual Clauses adopted by the European Commission (or the UK International Data Transfer Addendum) with the recipient.

Retention and Deletion of Information

We store your information for as long as needed to provide our services and as long as we are legally obliged to. We may store information longer only in a form that cannot be traced back to you. We delete information as soon as we no longer need it to provide our services, and in any event no later than five (5) years after your interaction with our products has ceased.

Traffic information is erased or anonymized when it is no longer needed for the transmission or, for paid services, at the end of the period during which the bill may lawfully be challenged or payment pursued. Information used for direct marketing is kept only as long as necessary for that purpose, or until you opt out. This does not prevent technical storage of or access to information solely to carry out the transmission of a communication or where strictly necessary to provide a service you requested.

When information is no longer needed, we delete it using reasonable measures to protect it from unauthorized access or use.

Request User Data Deletion

We and our third-party partners collect data to provide you with the services you asked for, and to run analytics and understand how users interact with our products and services so we can improve them.

We share data with the following third-party partners:

  • AppsFlyer
  • AppLovin
  • The advertising partners listed in the “Who Can Show Personalized Ads to Me?” section

To request deletion of data collected about you or your device by our third-party partners acting as independent controllers:

Children

Our products and services are intended for a general audience and are not directed to children under the age of digital consent in their country under European data protection law. Our Apps do not ask for your age, and they have no account system or features for contacting other players. We do not knowingly collect personal information from such children, except for persistent identifiers used as described in this Privacy Policy. If we learn that we have collected other personal information from a child under the age of digital consent, we will take all reasonable steps to delete it as soon as possible. If you become aware that your child has provided us with personal information without your consent, please contact us at info@movingeye.games.

Your Data Protection Rights

You have the right to:

  • access the personal data we hold about you
  • have inaccurate data rectified or updated
  • have your data erased
  • restrict processing of your data
  • object to processing based on legitimate interests, including profiling
  • receive your data in a portable format (data portability)
  • withdraw consent at any time, where processing is based on consent, without affecting the lawfulness of processing before withdrawal or processing on other legal bases

To exercise these rights, contact info@movingeye.games. You can withdraw consent to advertising and analytics features directly in the App settings. We will respond within one month of receiving your request, which may be extended where permitted by law. We may ask for information to verify your identity.

You can also control the information we collect in other ways, for example by disconnecting your social network accounts from our games, adjusting your social network privacy settings, or resetting or deleting your advertising identifier in your device settings.

You have the right to lodge a complaint with a supervisory authority. Our lead supervisory authority is the Information Commissioner of the Republic of Slovenia (Informacijski pooblaščenec), Dunajska cesta 22, 1000 Ljubljana, https://www.ip-rs.si. You may also contact the data protection authority in your country of residence. In the United Kingdom, this is the Information Commissioner’s Office (https://ico.org.uk, telephone 0303 123 1113).

Third-Party Websites and Services

Our Apps and Websites may contain links to third-party websites, products or services, for example offers from third-party advertisers. These are developed and administered by people or companies not affiliated with or controlled by us. This Privacy Policy does not apply to them, and your use of them is subject to their own rules and policies. We are not responsible for their privacy practices, content, products or services, or for their use of information you provide to them. A link to a third party does not constitute our sponsorship of, affiliation with, or endorsement of that third party or its privacy or security practices. We encourage you to learn about the privacy practices of the third parties you interact with.

Security

We have implemented appropriate technical and organizational measures to protect the confidentiality, security and integrity of the collected information and to prevent unauthorized access or use contrary to this Privacy Policy. Although we use commercially reasonable efforts to keep your information secure, no security measures are perfect or impenetrable.

Changes to This Privacy Policy

We may amend this Privacy Policy from time to time. Any changes will be posted here, and the amended version will supersede this version. We will take reasonable steps to draw your attention to changes, including an in-app banner and a link for material updates. If we change the way we use your email address, we will notify you by email in advance, and the change will take effect on the date stated in that email. The current version is always available at https://movingeye.games/eea.

English Language

By accepting this Privacy Policy, you acknowledge that you are proficient in English, or have consulted an advisor who is sufficiently proficient in English, so as to understand its terms.
