As used in this Privacy Policy, “Moving Eye”, “We”, “Us” or “Our” refers to Moving Eye, informacijske tehnologije, d.o.o., a limited liability company with its registered address at Dalmatinova ulica 5, 1000 Ljubljana, Slovenia.

If you are located in the European Economic Area, Switzerland or the United Kingdom, our EEA Privacy Policy at https://movingeye.games/eea applies to you instead of this Privacy Policy.

This Privacy Policy is part of and incorporated by reference into the Terms of Service (the “Terms”) governing the use of all Moving Eye branded software applications (the “Applications” or “Apps”), which may operate on any type of computing device (including, without limitation, a mobile device). It also applies to your use of https://movingeye.games and any URL which may replace it or be added to the list of websites published by us and linking to this Privacy Policy (the “Websites”).

We take the privacy of our users and data security very seriously and believe in the right of our users to know which data is collected and for what purpose. We therefore strive to make our actions transparent, allow our users to control the collected data and remove it if they so wish, and take all reasonable precautions to prevent unauthorized access to this data.

We process your information as described in this Privacy Policy. Where the law requires your consent, for example for interest-based advertising or for access to your device’s advertising identifier, we ask for it through the consent choices presented in our Apps, and you can change your choices at any time in the App settings.

We may share your information (including personal information) with our affiliates and with third-party Partners (as defined below) and use it in ways consistent with this Privacy Policy. We may transfer and store your information in Slovenia and in other countries where Moving Eye or its service providers operate, as described in the “International Transfer” section.

Interest-Based Ads

We promote our Apps and services in our own and other publishers’ apps, and we allow our partners to promote and advertise their goods and services in our Apps. Where you have given consent where required and have not opted out, we and our advertising partners may display interest-based or retargeted ads (“IBA”).

For such users, we may pass information we collect from you to our advertising partners, who may reuse it for targeted advertising. This may include technical information, advertising and application usage information (for example, whether a device has clicked on a sports ad within our Apps; see the “Information and Data We Collect From You” section). Our partners may combine information gathered from our Apps with information gathered from other apps, websites or services, build profiles, and transfer the information to another provider. For example, we pass advertising IDs to Meta, which matches them with your Facebook ID, aggregates them and deletes the initial identifier. Advertisers may then choose their audience by location, demographics, likes, keywords, age and gender, interests, behaviors, connections and any other information Meta receives or infers about users.

We cooperate with the following IBA providers (“Third Parties”). Please review their privacy policies to understand their data processing practices, including the technologies they use for interest-based advertising:

You can opt out of sharing your information for interest-based advertising at any time. When you opt out, you will still see ads, but they won’t be based on your interests, behavior or demographics. You can opt out in any of the following ways (see the “Opt-Out” section for details):

a) Via our Apps: change your consent choices or select “Opt out of IBA” in the App settings (where available).

b) Via your device settings: on iOS, turn off “Allow Apps to Request to Track”; on Android, delete your advertising ID.

“Do Not Sell or Share My Personal Information” Rights

If you are a California resident, the California Consumer Privacy Act (CCPA) may permit you to opt out of the “sale” or “sharing” of your “personal information” to “third parties” (as those terms are defined in the CCPA). The CCPA recognizes certain exceptions, so not all transfers of personal information are “sales”.

You can opt out of the sale or sharing of your personal information for interest-based advertising at any time by selecting “Opt out of IBA” in the App settings (where available) or by using the device settings described in the “Opt-Out” section.

Information and Data We Collect From You

1. Technical Information and Data

We may collect technical data necessary for you to use our Apps, and additional technical data that enables us to maintain and analyze the functioning of the Apps, personalize their content, and display advertisements.

We may automatically obtain certain information about your computing device, including:

  • IP address and country code
  • IDFA, IDFV and Advertising ID
  • Language and time zone
  • Session start and stop time
  • Network status (Wi-Fi, etc.), browser plug-in types and versions
  • User agent string, platform, SDK version and timestamp
  • Technical device information (e.g. device model and name, operating system name and version, CPU information, storage size, screen size, firmware, software, mobile carrier, internet service provider, API key identifier for the application, Android ID)
  • Player identifier string (collected only when you sign in to Google Play Games Services or Apple Game Center)

In addition, for users of Android devices we create a unique user ID, and for users of iOS devices we use the IDFV, to track your use of our Apps.

Older versions of our Apps may still obtain information such as UDID or IMEI numbers, or Android serial numbers. To prevent this, please update the App to the latest version available in your app store.

Although some of this information may uniquely identify your device, it does not identify you personally. Some laws, including the CCPA, treat information that uniquely identifies your device as personal information.

2. Advertising and Application Usage Information and Data

When you use our Apps, we may collect additional information using device identifiers that permit identification of your device. We use this information for advertising and analytics purposes. It includes:

  • Which advertisements are shown
  • How long an advertisement is visible, and its size
  • Your response to advertisements (if any), including clicks
  • Application usage information: how often and for how long you use the App, in-app events, in-app location, in-app purchases and their value, aggregated usage, performance data and lifetime value

3. Classical Personal Information

Our Apps have no account system, and we do not ask you for your name, email address, age, year of birth, gender or any other information that identifies you directly. The only personal information we collect through our Apps are persistent identifiers (such as IDFA, IDFV, Advertising ID and IP address). Persistent identifiers do not identify you personally, but may uniquely identify your device, and some laws treat them as personal information.

When you contact us directly, we may collect the information you provide (such as your name, surname and email address). We will use it only for the purpose for which you provided it and will not share it with third parties. To have this contact information deleted, please email info@movingeye.games.

How We Use Your Information

1. In General

We and our Partners use the information we collect about you and your device to deliver our services and operate our business, including:

1.1. Delivering our services: developing, delivering and improving our products, services and content; tailoring our products and services; providing software updates and product support; administering the Apps; and communicating with customers.

1.2. Displaying advertisements: displaying third-party advertisements in our Apps. See the “Advertising” section.

1.3. Analytics and research: understanding and analyzing trends in the usage of the Apps, gathering demographic information about our user base, and learning where the App was downloaded from. Where you have consented, this includes aggregated age-range, gender and interest reports provided by Google Analytics for Firebase (see “Google Analytics for Firebase” below). We may also create reports and analyses for research or business intelligence, for example to track problems or trends with our Apps or to test new game features and content. We use data received from third-party social networks only for internal analytics. To opt out of analytics, see the “Opt-Out” section.

2. Local Notifications

Our Apps may show local reminder notifications about your activities within the App. These are scheduled and sent by the App on your device only. They are not sent from our servers, and we do not collect notification tokens. You can turn them off at any time:

  • iOS: open Settings → Notifications, select the App, and turn notifications off.
  • Android: open Settings → Apps, select the App, choose Notifications, and turn them off. In some Apps, you can also disable notifications in the App’s Settings menu.

How We Share Your Information With Third Parties

Third-Party Social Networks

Some of our Apps let you connect to third-party social networks, such as Google Play Games Services or Apple Game Center, to share content you created, participate in leaderboards or multiplayer games, log in on multiple devices and synchronize progress. If you use these features, you share information with other players and with the social network (for example, scores, rankings and achievements).

Partners Working for Us

We have partners who perform services on our behalf, such as data storage, technical or customer support, and data analytics. These processors are contractually required or bound by law to protect your data and may process it only in accordance with our agreements with them.

Other Companies and Public Authorities

We may supply or disclose your data, including personal information, to third parties based on your consent or where required by law.

We cannot provide all services necessary for the operation of our products ourselves, so we share collected information with third parties (collectively, “Partners”). We may share information that can identify your device (e.g. persistent identifiers such as IDFA, IDFV, Advertising ID and IP address) to develop and deliver our services, conduct analysis and research, and measure our and our Partners’ advertising campaign performance. We may share such information with:

  • Our analytics providers: we use third-party analytics to deliver our services and conduct analysis and research. See “Google Analytics for Firebase” below.
  • Our cloud service providers: we may store information we collect on servers provided by third-party cloud service providers.
  • Third-party advertising partners: we work with third-party advertising networks that help us deliver advertising, which allows us to offer the Apps for free or at low cost. See the “Advertising” section.
  • Advertising partners’ third-party tracking providers: for some Apps, we may allow our advertising partners to track impressions, clicks, installs or other campaign performance indicators through their tracking providers. See the “Tracking” section.

We may contract with additional Partners or change existing Partners in the future. We update this Privacy Policy twice a year, or promptly in case of material changes in our data processing practices.

We reserve the right to disclose your information (including personally identifiable information) in response to law, legal process, litigation or requests from public and governmental authorities within or outside your country of residence. We may also disclose information about you where we determine that disclosure is necessary or appropriate for national security, law enforcement or other issues of public importance, or reasonably necessary to enforce our terms and conditions or protect our operations, users or user experience. In the event of a reorganization, merger or sale, we may transfer any and all information we collect to the relevant third party.

Google Analytics for Firebase

We use Google Analytics for Firebase, provided by Google LLC, to understand how players use our Apps. This includes Google Analytics Advertising Features (Google signals and demographics and interests reporting).

Where you have given consent, Google may use your device’s advertising identifier (Android Advertising ID or Apple IDFA) and information associated with your Google account (if you are signed in to Google and have turned on ads personalization) to provide us with aggregated reports about the age ranges, gender and interests of our players. These reports contain only aggregated data, and we cannot identify individual users from them.

You can withdraw your consent at any time in the App’s privacy settings, reset or delete your advertising ID in your device settings (see the “Opt-Out” section), or manage your Google ad settings at https://myadcenter.google.com. For more information on how Google uses data from apps that use its services, see https://policies.google.com/technologies/partner-sites.

How Our Partners May Use Your Information

We strive to follow generally accepted industry practices regarding the collection and use of information by our Partners and to limit their use to the services they provide for us. Partners adhere to this Privacy Policy, but in some cases their own privacy policies apply.

We strive to commit our Partners to using the information solely for the purposes stated in this Privacy Policy. However, we cannot guarantee that our Partners will adhere to their contractual obligations or acceptable business practices. While we strive to protect the information provided to our Partners, we have no direct control over their use of it.

Advertising

When you use our Apps, we may display contextual advertisements to you. To enable advertising, we allow our advertising partners to collect online identifiers (such as the Advertising ID on Android and the IDFA on iOS). Unless interest-based advertising applies to you as described below, our partners may use these identifiers only for contextual advertising, and for any other purpose only on an anonymized and aggregated basis.

In some territories, where you have given consent where required, we may use and share with our advertising partners the technical, advertising and application usage information we collect from you (see the “Information and Data We Collect From You” section). This enables our partners to deliver, target and optimize third-party advertising in our Apps, so that the ads you see are more relevant and based on your app and device usage, online behavior and interests (interest-based advertising, “IBA”). We may also use and share such information with our advertising partners to target and optimize our own advertising and promotions in our Apps and in other publishers’ apps.

We always follow applicable law and accepted market practices. We do not knowingly use or share information for behavioral advertising for children under 13, and we do not do so for users who have not given consent where it is required or who have opted out of IBA. Tracking

When you use the App, we or third parties operating ad-serving technology may use information logged from your device through SDKs, cookies, web beacons and similar technologies. We do this to ensure that appropriate advertising is shown in the App and to count unique and repeat ad views.

For some of our Apps, we use third-party tracking and data collection tools to track performance, ad visibility and the privacy compliance of third-party SDKs in our Apps.

We use third-party tracking and data collection tools to measure and optimize our advertising campaigns, display advertisements, conduct analysis to improve our services, and prevent fraud. These tools may use cookies, APIs and SDKs in our Apps to collect and analyze user and device data, such as impressions, clicks, installs, other campaign performance indicators and post-install in-app events.

Our Partners may also use their own tracking technologies (including, without limitation, SDKs, cookies, web beacons, HTTP cache and local shared objects) to track impressions, clicks, installs or other campaign performance indicators for measuring third-party advertising campaign performance.

Third-Party Terms and Conditions

Your access to and use of the Apps may be subject to third-party terms and conditions and privacy policies, including those of app stores, mobile software platforms, online gaming platforms, social networking services, statistics service providers and payment providers.

Our Apps may contain links to third-party websites, products or services. For example, the Apps may feature offers from third-party advertisers or allow transactions with them. These are developed and administered by people or companies not affiliated with or controlled by us. We are not responsible for their actions, content, products or services, or for their use of information you provide to them. A link to a third party does not constitute our sponsorship of, affiliation with, or endorsement of that third party or its privacy or security practices. Information collected by third parties, which may include location information or contact details, is governed by their own privacy practices, and their websites or services may place their own cookies or other files on your device. We encourage you to learn about the privacy practices of the third parties you interact with.

Children’s Privacy

Our Apps are intended for a general audience aged 13 and over and are not directed to children under 13. We do not knowingly collect personal information from children under 13. Our Apps do not ask for your age, and they have no account system or features for contacting other players.

If we learn that we have collected personal information from a child under 13, we will take all reasonable steps to delete it as soon as possible. If you become aware that your child has provided us with personal information without your consent, please contact us at info@movingeye.games.

We strive to ensure that all our advertising partners follow appropriate standards for the collection, use and disclosure of children’s personal information, but we cannot be responsible if they breach their commitments to us. For details on disclosure to third parties, see the “How We Share Your Information With Third Parties” section.

Opt-Out

You can stop all future collection of your information by us at any time by uninstalling all our Apps from each of your devices.

You can opt out of interest-based advertising, analytics advertising features, and (for California residents) the sale or sharing of your personal information, in the following ways:

1. Via our Apps

Open the App’s Settings menu to change your consent choices. Where available, use the “Interest-based ads” setting to opt in or out for each IBA provider, or tick “Disable Interest-Based Ads” (found under Info Screen → Settings in some Apps). You will still see ads, but they will not be tailored to your preferences. To stop seeing ads altogether, you may make an in-app purchase where offered, or delete the App.

If you opt out through an individual IBA provider’s own mechanism, you should stop receiving interest-based ads from that provider, but may still receive them from others. To opt out of all IBA providers at once, use option 2 below.

2. Via your device settings

  • iOS 14.5 and later: go to Settings → Privacy & Security → Tracking and turn off “Allow Apps to Request to Track”, or turn it off for a specific App. You can also turn off “Personalized Ads” under Settings → Privacy & Security → Apple Advertising.   • Android 12 and later: go to Settings → Google → Ads and tap “Delete advertising ID”. On older Android versions, go to Settings → Google → Ads and turn on “Opt out of Ads Personalization”.

When you use these settings, our partners should not use information collected from your device to infer your interests or serve you interest-based ads, but we cannot guarantee their compliance. You may still see the same number of ads, but they may be less relevant, as they may be based on non-personal information such as the content of the App you are using. We provide no guarantees regarding information collected before you opted out. Some providers may offer additional opt-out mechanisms. You can reverse these choices at any time by changing the settings back.

We use advertising identifiers rather than permanent device IDs because advertising identifiers can be used only for advertising and can be reset or limited by users at any time through their device settings. All parties involved in advertising are required by app store guidelines to respect users’ choices.

Request User Data Deletion

When you install and use Moving Eye Apps, we and our third-party partners may collect and process some of your data for the following purposes:

  • to provide you with the services you asked for
  • to run analytics and understand how users interact with our products and services, in order to improve them continuously

The third-party partners we share data with are:

  • Firebase Analytics (Google)
  • AppsFlyer
  • AppLovin
  • The IBA providers listed in the “Interest-Based Ads” section

In-App Purchases

Our Apps enable in-app purchases. We do not process payments for in-app purchases and have no access to your credit card information. Payment transactions are completed by the app store through your app store account, and post-purchase processes are controlled by the app store and subject to its terms. For more information, see the In-App Purchases section of our Terms of Service at https://movingeye.games/terms.

Security

We have implemented appropriate technical and organizational measures to protect the confidentiality, security and integrity of the collected information and to prevent unauthorized access or use contrary to this Privacy Policy. Although we use commercially reasonable efforts to keep your information secure, no security measures are perfect or impenetrable.

Integrity of and Access to Personal Information

We strive to enable you to keep your information accurate, complete and up to date. We make good-faith efforts to give you access to the personal information you provide to us, and you can ask us to correct or delete it unless we are required to retain it by law or for legitimate business purposes. Requests may be sent to info@movingeye.games.

We may decline requests that are unreasonably repetitive, require disproportionate technical effort, jeopardize the privacy of others, are extremely impractical, or are not otherwise required by applicable law.

International Transfer

We operate globally, so we may transfer your information to our affiliated entities and to third-party service providers in other countries for the purposes described in this Privacy Policy. These countries may not have the same data protection laws as your own, but wherever your information is transferred, stored or processed, we take reasonable steps to safeguard it.

Retention and Deletion of Information

We store your information for as long as needed to provide our services. We may store it longer only in a form that cannot be traced back to you. We delete information as soon as we no longer need it for the purposes described in this Privacy Policy, and in any event no later than five (5) years after your interaction with all of our Apps has ceased, unless a longer retention period is required or permitted by law. Retention periods may differ by territory and applicable law.

When information is no longer needed, we delete it using reasonable measures to protect it from unauthorized access or use. If you ask us to delete your data, we will do so as described in the “Your Rights” section.

Your Rights

You have certain rights in connection with your personal information, which may be subject to exceptions or limitations under applicable law. You can exercise them at any time by contacting info@movingeye.games.

Rights of California residents

If you are a California resident, you have the following rights:

  • Right to know and access: you may ask what information we have collected about you and, in some cases, have it communicated to you. Let us know what information you would like to receive. We may ask for reasonable evidence to verify your identity. If we cannot provide some information, we will explain why. We will respond within 45 days of receiving your request and verifying your identity.
  • Right to deletion: you may ask us to delete the personal information we hold about you. We may ask for additional information to verify your identity. We will delete the requested information within 45 days of receiving your request and verifying your identity. We may retain some information to comply with legal obligations or protect or enforce legal rights, or in anonymized form.
  • Right to opt out of the sale or sharing of your personal information: see the “Do Not Sell or Share My Personal Information” Rights section.
  • Right to data portability: in some circumstances, you may ask us to provide the personal information you gave us so you can transfer it to another business.

California’s “Shine the Light” law permits California customers to request certain details about how their information is shared with third parties and, in some cases, affiliates for those parties’ own direct marketing purposes. To make such a request, contact info@movingeye.games. We may ask for information to verify your identity, and we are not required to respond to requests made through other channels.

We may decline requests that are unreasonably repetitive, require disproportionate technical effort, jeopardize the privacy of others, or are extremely impractical, where permitted by law.

Changes to Our Privacy Policy

We may amend this Privacy Policy from time to time. Any changes will be posted here, and the amended version will supersede this version. We will take reasonable steps to draw your attention to changes, and will inform you of material updates with an in-app banner and a link. We recommend reviewing this Privacy Policy regularly. The current version is always available at https://movingeye.games/privacy.

On request to info@movingeye.games, we will send you updates or previous versions of this Privacy Policy by email.

English Language

By accepting this Privacy Policy, you acknowledge that you are proficient in English, or have consulted an advisor who is sufficiently proficient in English, so as to understand its terms.
